2. Purpose of these terms

These General Terms of Use, hereinafter the “Terms of Use”, govern:

  • access to the Website;

  • use of its content and features;

  • creation and use of a customer account;

  • the possible publication of reviews or other content;

  • the security and conduct rules applicable to users.

Purchases made on the Website are governed separately by our Terms and Conditions of Sale, our Shipping and Delivery Policy and our Returns and Refund Policy.

By accessing the Website or using its features, you agree to comply with these Terms of Use to the extent permitted by applicable law.

If you do not accept these terms, you must stop using the features concerned.

Simply browsing the Website does not replace the separate acceptance of the Terms and Conditions of Sale required before an order.

ELVYNECO is an online store operated by VERALYA LTD.

The Website mainly presents products in the beauty, personal care and self-care categories. The catalogue and categories may change depending on the products actually selected and sold.

Only products actually shown as available on the Website can be ordered.

6. Access to the Website and legal capacity

General browsing of the Website is available subject to applicable legal or technical restrictions.

  • have the necessary legal capacity;

Suspension or closure of an account does not cancel rights relating to an order already concluded, a refund, a statutory guarantee or the protection of personal data.

Nothing in these Terms of Use transfers to you any ownership right in the ELVYNECO brand or in the content of the Website.

  • is accurate to the best of your knowledge;

  • does not contain unnecessary personal information;

  • does not infringe the rights of a third party;

You retain ownership of your content.

You grant VERALYA LTD a non-exclusive, worldwide, royalty-free licence to host, reproduce, technically adapt, translate, display and promote this content in connection with ELVYNECO and its commercial communications.

This licence applies for the period necessary for these uses. It does not authorise VERALYA LTD to attribute to the user statements they did not make.

You must hold the necessary rights in any content you submit.

16. Content moderation

VERALYA LTD may moderate, refuse or remove content where there is a reasonable ground to consider that it:

  • breaches these Terms of Use;

  • is false, fraudulent or manifestly misleading;

  • infringes a right;

We do not undertake to publish all reviews received. However, we will not remove a review solely because it expresses a negative opinion in good faith.

Sponsored reviews, reviews that were rewarded or reviews received in exchange for a benefit must be clearly identified.

These Terms of Use do not limit the remedies provided in the Terms and Conditions of Sale or by applicable law.

The contact details of any mediator designated for a particular market are or will be shown in the Terms and Conditions of Sale and the information intended for the consumers concerned.

As the former European online dispute resolution platform has been discontinued, no link to that platform is provided.

24. Governing law and competent courts

These Terms of Use are governed by the law of England and Wales.

For a consumer, this choice does not remove the mandatory protections granted by the law of the country in which they habitually reside.

Nothing requires consumers to submit exclusively to the jurisdiction of the English courts where the mandatory rules applicable to them allow them to bring proceedings before a court in their country of residence.

25. Severability

If a provision of these Terms of Use is declared invalid, unlawful or unenforceable, the other provisions remain in force.

The provision concerned will be applied to the fullest extent permitted by law or replaced by the applicable mandatory rule.

26. No waiver

The fact that VERALYA LTD does not immediately exercise a right does not constitute a waiver of that right.

Any waiver must be clear and applies only to the situation concerned.
