1. Acceptance of these Terms

By accessing or using elvyneco.com, you agree to these Terms of Use. If you do not agree, you must not use the Site.

We may update these Terms from time to time. The revised version will be published on this page with an updated date. Where required by law, we will provide additional notice of material changes.

2. About ELVYNECO

ELVYNECO is an online retail store operated by VERALYA LTD, a private company limited by shares registered in England and Wales under company number 16839333.

We offer products in categories that may include women’s fashion, lingerie, sportswear, beauty, personal care and wellness through our Shopify store at elvyneco.com.

3. Access and Eligibility

To place an order, you must:

  • be at least 18 years old;

  • have the legal capacity to enter into a binding contract; and

  • be legally permitted to purchase and receive the relevant products in your location.

You may browse the Site if you are under 18 only with the involvement and supervision of a parent or legal guardian, where permitted by law.

4. Customer Accounts

You may be able to create or use a customer account. You are responsible for:

  • providing accurate, current and complete information;

  • keeping access to your email account and authentication method secure; and

  • notifying us promptly if you suspect unauthorised access.

We may suspend or restrict an account where reasonably necessary to protect the user, prevent fraud, comply with law or address a material breach of these Terms.

5. Products and Availability

Products are subject to availability. We may change or discontinue products at any time, but this will not affect an order already accepted unless permitted by law.

We take reasonable care to display product descriptions, measurements, colours and images accurately. Images are illustrative and the appearance of colours may vary depending on your device or screen settings.

Product-specific instructions, warnings and restrictions form part of the product information and must be followed.

6. Prices and Payments

Prices are displayed in the currency applicable to the selected market. Applicable taxes and shipping charges will be shown at checkout before you submit an order.

Payment methods may include major debit or credit cards, Shopify Payments, PayPal, Shop Pay and other methods displayed at checkout. Transactions are processed by the relevant payment provider in accordance with its own terms and privacy policy.

7. Orders

Submitting an order constitutes an offer to purchase. An automated acknowledgement confirms receipt but does not necessarily constitute acceptance. Unless we state otherwise, the contract is formed when we confirm acceptance or dispatch.

We may refuse or cancel an order before acceptance for legitimate reasons such as product unavailability, an obvious error, failed payment, suspected fraud, delivery restrictions or legal requirements.

Orders are normally processed within 1–2 business days, excluding weekends and UK public holidays.

8. Shipping and Delivery

We deliver to the countries and regions enabled at checkout. Delivery availability, charges and estimates vary by destination and product.

Our general international delivery estimate is 5–10 business days after dispatch unless a different estimate is displayed at checkout. Please read our Shipping Policy for full details.

9. Returns and Refunds

Eligible purchases may benefit from our voluntary 90-day money-back guarantee. Statutory cancellation and conformity rights may also apply.

Certain sealed products that are unsuitable for return for health-protection or hygiene reasons may be excluded once unsealed. This does not limit rights relating to faulty, damaged, incorrect or non-conforming goods.

10. Intellectual Property

Unless otherwise stated, the Site and its content—including text, graphics, logos, images, videos, designs, software and product descriptions—are owned by or licensed to VERALYA LTD and are protected by applicable intellectual-property laws.

You may access and use the Site for personal, non-commercial shopping purposes. You must not copy, reproduce, modify, distribute, republish, scrape, commercially exploit or create derivative works from Site content without prior written permission, except where permitted by law.

Third-party trademarks and content remain the property of their respective owners.

11. Prohibited Uses

You must not use the Site:

  • for any fraudulent, unlawful, abusive or harmful activity;

  • to infringe intellectual-property, privacy or other rights;

  • to upload or transmit malware or harmful code;

  • to interfere with the security, availability or operation of the Site;

  • to gain unauthorised access to any system, account or data;

  • to collect information about other users without a lawful basis;

  • to impersonate another person or misrepresent an affiliation;

  • to place fraudulent orders or misuse promotions; or

  • in any way that violates applicable law.

We may take proportionate action in response to suspected misuse, including restricting access, cancelling affected orders or reporting unlawful conduct where appropriate.

12. Third-Party Services and Links

The Site may contain integrations with, or links to, third-party services such as payment providers, delivery services, Shop, Shop Pay or social networks.

We do not control independent third-party services. Their own terms and privacy policies may apply when you use them. A link does not necessarily imply endorsement.

13. Website Availability and Disclaimer

We aim to keep the Site available and accurate but do not guarantee uninterrupted, error-free or continuously secure access. We may suspend or modify parts of the Site for maintenance, security, legal or operational reasons.

General beauty and wellness information provided on the Site is for informational purposes only and is not medical advice. Always follow product instructions and seek professional advice where appropriate.

Nothing in this section affects your statutory rights regarding products purchased from us.

14. Limitation of Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or liability arising under mandatory consumer law.

Subject to the preceding paragraph and to the fullest extent permitted by law, VERALYA LTD will not be liable for indirect, incidental or unforeseeable losses arising from your use of the Site.

The Site is intended primarily for consumers. If you use it for business purposes, we will not be responsible for loss of profit, revenue, business, anticipated savings, data or opportunity, to the extent permitted by law.

15. Consumer Rights

These Terms do not affect your mandatory statutory rights. UK consumers may have rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Consumers in the European Union may benefit from mandatory EU and national consumer-protection rules.

16. Complaints and Dispute Resolution

Please contact us first at support@elvyneco.com so that we can try to resolve your complaint directly.

EU consumers may obtain information about recognised alternative dispute-resolution bodies from the European Commission’s consumer-redress resources or the competent authority in their country. The former European Online Dispute Resolution platform was discontinued on 20 July 2025 and is therefore not referenced as an active complaint service.

Nothing in this section limits your right to bring a claim before a court with jurisdiction under applicable law.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales.

If you are a consumer, you retain any mandatory protections provided by the law of your country of residence. Nothing in these Terms deprives you of the right to bring proceedings in a court that has jurisdiction under applicable mandatory law.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force to the extent permitted by law.

19. No Waiver

If we do not immediately enforce a provision of these Terms, this does not mean that we waive the right to enforce it later.
